Rubik’s Cube owner take trade mark swipe at Toys ‘R’ US

Rubik’s Brand, who own the rights to the Rubiks Cube following its creation by Ernő Rubik in 1974, have put their foot down and taken action against Toys ‘R’ Us and Duncan Toys for copy cat toy.
The claim is based on the allegation that the two toy retailers are creating knock-off version of the worldwide recognised retro toy.
The toys sold by Duncan Toys and Toys ‘R’ US are described in the claim as a copy and emulation of the distinctive appearance of the Rubik Cube.
The potential copy cat toys have changed black edging to white and have rounded corners.
Rubik’s Brand argue that this is not enough to negate a likelihood of confusion.
Rubik’s Brand also argues that Toys ‘R’ US have caused irreparable harm to its reputation by selling the copy cat products.
Using their US trade marks as a springboard for the action, Rubik’s Brand are seeking injunctive relief, destruction of all infringing goods, triple damages and profits deriving from the infringement.
Seeing as the Rubik’s Cube is one of the world’s most recognised toys, it seems that they wont be happy until this battle is won.
