I have a new recipe which I would like to protect- any ideas?

Provided ( amongst other things) the recipe has been written down in some format a recipe may attract copyright protection as a literay work under the Copyright Designs and Patents Act 1988 (the 'CDPA'). If you have taken the photographs or commissioned someone to take photographs then there may well be protection in the images too.

Problems with copyright?

Its difficult to establish copying and someone would only have infringed your rights if the literary work or artistic work was copied in some way.


You could also file for a patent under the Patents Act 1977 ( as amended). You would filing for a process ie 'making a cake comprising the following.....'

Problems with Patents is the inventive step and sufficiency arguments and many dont get past the starting post.
