LG Block PS3

LG have obtained seizure of Sony PS3's.

The Korean consumer electrics giant LG obtained a preliminary injunction preventing the importation of Song PS3 games consoles into the EU for at least "10 days". The injunction is allegedly based on patents which cover the Blu-ray facility on the PS3 console.

This is not the first time that LG and Sony have been in dispute. Late last year Sony filed a patent infringement complaint with the US International Trade Commission claiming that LG had infringed several Sony patents on mobile phone technology and asked for the import of LG mobile phones to the US to be prevented. In return LG filed a similar complaint in respect of the PS3's Blu-ray functions.

Under Council Regulation (EC) No 1383/2003 where a shipment has been seized the claimant (LG) has 10 days to initiate proceedings, in the meantime customs will keep hold of the goods. If LG wish to permanently seize the goods then they will need to show infringement in the member state in which the goods have been seized.
