IP Basics- Someone is using my IP, what can I do?

One of the best assets your business can have is Intellectual Property and it is important that it is protected.
If it is correctly protected and you find someone is using it without your permission, you have rights to fight against it.
The act of a third party using your IP without you knowing is called IP Infringement.
As the owner of protected IP, you have the rights to take steps to prevent anyone using it.

There are a number of actions you can proceed with including a cease and desist letter which gives a warning to the infringer to stop their illegal actions, mediation where you come together to discuss the issue or if these don’t work you can take the matter to court.
If you choose to go to court, you will most likely be dealing in the Intellectual Property Enterprise Court where a specialist judge can hear disputes relating to all types of IP including trade marks, designs, copyright or patents.
