Apple Wins Round One of Patent Battle

Apple has accused rival mobile phone company HTC of infringing ten of their U.S patents. After a preliminary ruling in conducted by the International Trade Commission (ITC), HTC have been found guilty of infringing two.

It has been held that HTC have infringed patents relating to "system and method for performing an action on a structure in computer-generated data", which was awarded to Apple in 1999. Further to bringing a claim against HTC, Apple has also filled complaints against Samsung and Motorola regarding infringement of the same patent; although these are yet to be decided.

As previously stated the ruling is only preliminary and the final decision is due to take place on the 6th December 2011. HTC remain confident that their appeal will be successful, although if they do not succeed this could potentially lead to an import ban into the U.S.
