Amazon's revoked patent to be given a second chance

Amazon's patent, which in essence, allows individuals to send a gift to another individual, when the sender only knows the email address of the recipient, and not their postal address, was revoked by the EPO following opposition proceedings.

However, The Board of Appeal, who heard the appeal lodged by Amazon, has held that although the patent should have been revoked, the more limited claims relating to details of technical implementation of the invention should be considered further. The Board of Appeal's reasoning for its decision has not yet been made available.

Amazon's patent has therefore been given a second chance. Indeed The Board of Appeal at least seems willing to consider the patentability of this business method.

The Board of Appeal's decision will be published in due course.
