Whilst this case will be settled ( Paddy Power wants the PR not the legal costs) and it will be settled in the Republic of Ireland. The Law in England and Wales is quite clear on so called image rights

In a decision earlier this year the Court of Appeal onfirmed the basic principle that there are no celebrity image rights under English law, but that passing off would be applicable where th activities of a retailer selling for example a T-shirt bearing the image of a pop star amounted to passing off. 

Here I would presume Kenao had authorised his image to be used on a billboard. He had not; so why should PP benefit? A clear case of passing off. 

Not that Paddy Power will give a hoot anyway.
