(1) Notifications: If the trademark register authority relevant to your registration informs us of a similar filed mark, we get in touch with you and discuss the next steps. This may involve us objecting to the new application or even contacting the other side with a view to limit its scope in some way. Either way Lawdit can handle the contentious side of trade marks for you. We can also conduct regular searches of any trade mark database to keep you informed.
(2) Cease and Desist: if you notice a third party using your trade mark or a very similar international or uk trademark registration, we can send a cease and desist letter to prevent its use. We can also attempt to recover lost profits and your legal fees. Our team have extensive knowledge of such matters and currently handle large scale cease and desist campaigns for a number of high street brands and well known PLCs.
(3) Court Action: if the matter is not resolved via a cease and desist letter (or follow up letters) we have the expertise and knowledge to issue a High Court claim. We also have Solicitor-Advocates in our team here at Lawdit which means we don’t need to instruct a Barrister and can deal with the matter from start to finish.
(4) Domain Recover: if you wish to avoid court action but wish to recover a domain name which is similar to your trade mark we can assist you. We have experience in handling complex domain recovery matters from the initial approach all the way to the filing and conducting of the complaints procedure dispute.
(5) Licenses and Assignments: when your brand is successful others will often try to use it. Sometimes this means we have to send cease and desist letters as above, however other times you may simply be approached by a third party for a licence to use or even an agreement to buy the trade mark. Again we can help you negotiate, draft the agreement and execute it.
