OFT requires Apple Inc to change its terms and conditions

3 December 2009

OFT requires Apple Inc to change its terms and conditions

In a recent investigation by the OFT into Apple Inc's terms and conditions and as a result of the concerns raised by the OFT under the Unfair Terms in Consumer Contracts Regulation 1999 (UTCCRs), Apple has agreed to change its terms and conditions to make them clearer and fairer for consumers and to comply with the UTCCR’s.

The Terms that require updating are those which apply to consumers who buy from Apple and iTunes stores and download software from the web. Apple Inc has now agreed to revise its standard conditions to ensure these do not exclude liability for faulty or mis-described goods, are consistent with consumer rights under the Distance Selling Regulations, are drafted in plain or intelligible language and do not potentially allow changes to be made to products and prices after an agreement is made.
