Can I Sell a Trade Mark

31 January 2008

By Jody Tsigarides

Yes

Once you have a registered trade mark it belongs to you and it is just as valuable and and can be utilised the same way that you would, for example, a vehicle

A trade mark can be sold for any value over £1 and this will depend on what someone is prepared to pay for it. The more reputable a brand name the more someone will pay for it

Once you have agreed a price you need to do 2 things: 1) let the governing trade mark office know - this will usually be done via a form on its websiter and 2) have a legal assignement drafted and signed by both parties

Once this is done the ownership will transfer and with it all of the rights.

is a trainee solicitor who specialises in intellectual property law and in particular, trade mark law. technology law and intellectual property law.
