L' Oreals battle with counterfeit goods goes on… and on.

To France we go for the setting of L'Oreal's latest battle with counterfeit goods, and in particular the Tribunal de Grande Instance. The court has ruled that eBay was not liable for it's users who sold counterfeit products produced, marketed and sold by L'Oreal. This result comes as no surprise as cases similar to the aforesaid have been herd in the past in the US and Belgium.

The Court was also satisfied that eBay were doing enough to stop the sale of counterfeit goods. The internet auction site when notified seeks to remove all auctions which are auctioning counterfeit goods.

It is clear that whilst the brand owner on this occasion lost the battle, it appears that the war has not been lost, as further actions are likely to follow in this continuing war on counterfeit goods.
