Debt Collection Services In UK

UNPAID COMMUNITY FEES-CAN YOU RECOVER THEM?

Every year residents of developments must pay a sum of money to the administrator of the development in community fees. We are aware of many residents in the UK who simply ignore these demands and in some cases these fees remain outstanding for many years. Thousands, perhaps millions of Euros are being unclaimed. We saw an opportunity to address the problem and would therefore like to introduce you to the Lawdit recovery team.  We can promise you that the debtor will be chased by Solicitors robustly and vigorously but above all fairly.

1. A letter before action explaining the sums owed and why these sums must be paid. That is it is for the benefit of the community that the fees are charged. It is unfair that some residents pay and some do not pay but all enjoy the benefits of the community. Indeed we warn the residents that they could well lose their home.

2. A telephone call is then made seeking to speak to the debtor. From our experience often the debtor is unaware that fees have to be paid and their response is “how much and where do I pay” No resident will want to lose their property.

3. Finally after 28 days from the first letter we send a final letter explaining that we are disappointed that no response has been received and that matters will now be passed back to the community management companies who may well know take possession proceedings.

4. We have a Content Management System database which updates all calls made to debtors and letters sent. This information is continuously updated and provided to the client.

5. These three steps will we are sure result in the UK residents paying you or your client the unpaid community fees.

6. Fees

To complete the above steps 1-3 the following fees will be charged

1-50 Debtors: A management and Administrative fee of 600 Euros. Success fee of 20% of all monies.

50-100 Debtors: A management and Administrative fee of 800 Euros. Success fee of 30% of all monies.

100 + Debtors ( maximum of 300) : A management and Administrative fee of 1.300 Euros. Success fee of 40% of all monies.

CONTRACT ENFORCEMENT FOR DEVELOPERS

Our services are aimed at assisting Spanish developers who have entered into legal contracts with international buyers for the sale of properties in Spain. In many cases these properties have been sold off the plans prior to being built. Contracts for the sale of these properties have been signed by European and international buyers and deposits have been taken.

With the present downturn in the global economy the property market has suffered greatly and circumstances have changed for both buyers and sellers. Purchases, who are contractually and legally bound by their purchase contracts, are unlawfully refusing to fulfil their legal obligations under their contractual agreements and are leaving developers to incur further losses.

In many cases the contracting parties believe that because they are resident in a foreign country to Spain that they can simply walk away from their legal obligation.

Lawdit Solicitors are specialist litigators/debt recovery agents.

It is a regular occurrence for Spanish property owners residing in the UK, Europe and elsewhere to fail to pay the agreed community maintenance charges owed for the general upkeep of the properties which they have purchased.

In many cases these purchasers expect the Community Management Companies to simply continue the upkeep of these properties without any contribution from them.

Although the management companies who maintain these properties are able to claim against potential foreign debtors, these procedures are created according to the Spanish legal system and are effectively ignored by the large majority of these non Spanish resident individuals. Lawdit Solicitors can recover these debts from any debtors both here, in Europe and further afield.
